Read the account of Robert Harris (a pdf in Canvas, pages 268-274). As the account states, Harris was convicted and given the death penalty, but consider, hypothetically, that the trial was invalidated upon a technicality and Harris must be tried again. You are a member of this new jury and are given all the facts about Harris’s actions and recent behavior as well as the many circumstances of his life that led up to his crimes. The other eleven jurors contemplate the details of his childhood but disregard them because, according to them, Harris could have always chosen otherwise if the conditions were different; they say that Harris was never coerced to do what he did by someone else and, so, he freely chose his actions. Their proposed verdict is that Harris is definitely guilty. The eleven jurors now look at you for your decision. What do you decide? EXPLAIN WELL your decision based on the theories we discussed in class. In the course of your paper, consider these questions: Is Robert Harris morally responsible for his actions? How could someone argue against your view? How do you interpret the reasoning behind the other eleven jurors’ decisions? Do you agree with them?
You need to back up your decision using the theories we discussed in class (for example, causal determinism, hard determinism, compatibilism, and Existentialism), but there is no need to explain and discuss every theory, only those that you find useful in your paper.
