Each student will choose a single enforcement case either discussed in class, or one of your own, to review, analyze and submit via email. The enforcement case should be complex and involve a single/ multiple issues of a breach in legal and ethical rules by a company.
You should limit your case selection to one of the following executive branch agencies: 1) US Securities Exchange Commission (SEC), 2) US Commodity Futures Trading Commission (CFTC), or 3) US Department of Justice (DoJ).
The enforcement case should cover an area of non-compliance discussed in class such as, fraud, market manipulation, disruptive trading practices (e.g., spoofing), bribery, money-laundering, sanctions violations, etc.
Basic Information- Name of the case ( ? vs. ?), Civil, Administrative or Criminal action? Identify the “Parties” involved (i.e., the Government Agency (Prosecutor) and Respondent(s))
Summarize the facts of the case. (Limit to one page)
Identify the Issue(s) of alleged wrongdoing. (limit to one page)
Explain the rules/ law that applies to the actions of the company or individual(s) (limit to one page)
Analyze- Apply the facts to the law to determine if a violation occurred. (limit to one page)
Conclusion- What should the individual or company have done to avoid the violation? (limit to one page)
E-mail the final version of the paper (no more than 5 pages) as a PDF file.
